This essay describes and critically evaluates a co-operative educational program to train Ugandan health care workers in bioethics. It describes one bottom-up effort, a week-long intensive workshop in bioethics provided by the authors to health care professionals in a developing country—Uganda. We will describe the background and circumstances that led to the organization of the workshop, and review its planning, design, curriculum, and outcome. We will focus especially on measures taken to make the workshop relevant for the audience of Ugandan (...) professionals, and describe lessons learned after two presentations of the workshop. Finally, we will discuss the strengths and weaknesses of such a format, and its potential value in raising bioethical expertise in developing countries. (shrink)

This study aimed to explore experiences and practices of key research team members in obtaining informed consent for pharmacogenetics research and to identify the approaches used for enhancing understanding during the consenting process. Data collection involved 15 qualitative, in-depth interviews with key researchers who were involved in obtaining informed consent from HIV infected individuals in Uganda for participation in pharmacogenetic clinical trials. The study explored two prominent themes: approaches used to (...) convey information and enhance research participants’ understanding and challenges faced during the consenting process. Several barriers and facilitators for obtaining consent were identified. Innovative and potentially effective consenting strategies were identified in this study that should be studied and independently verified. (shrink)

On site monitoring of research is one of the most effective ways to ensure compliance during research conduct. However, it is least carried out primarily for two reasons: presumed high costs both in terms of human resources and finances; and the lack of a clear framework for undertaking site monitoring. In this paper we discuss a model for research site monitoring that may be cost effective and feasible in low resource settings.

BackgroundIn response to COVID-19 pandemic, the Government of Uganda adopted public health measures to contain its spread in the country. Some of the initial measures included refusal to repatriate citizens studying in China, mandatory institutional quarantine, and social distancing. Despite being a public health emergency, the measures adopted deserve critical appraisal using an ethics and human rights approach. The goal of this paper is to formulate an ethics and human rights criteria for evaluating public health measures and use it to (...) reflect on the ethical propriety of those adopted by the government of Uganda to contain the spread of COVID-19.Main bodyWe begin by illustrating the value of ethics and human rights considerations for public health measures including during emergencies. We then summarize Uganda’s social and economic circumstances and some of the measures adopted to contain the spread of COVID-19. After reviewing some of the ethics and human rights considerations for public health, we reflect upon the ethical propriety of some of Uganda’s responses to COVID-19. We use content analysis to identify the measures adopted by the government of Uganda to contain the spread of COVID-19, the ethics and human rights considerations commonly recommended for public health responses and their importance. Our study found that some of the measures adopted violate ethics and human rights principles. We argue that even though some human rights can sometimes be legitimately derogated and limited to meet public health goals during public health emergencies, measures that infringe on human rights should satisfy certain ethics and human rights criteria. Some of these criteria include being effective, strictly necessary, proportionate to the magnitude of the threat, reasonable in the circumstances, equitable, and least restrictive. We reflect on Uganda’s initial measures to combat the spread of COVID-19 and argue that many of them fell short of these criteria, and potentially limit their effectiveness.ConclusionThe ethical legitimacy of public health measures is valuable in itself and for enhancing effectiveness of the measures. Such legitimacy depends on the extent to which they conform to ethics and human rights principles recommended for public health measures. (shrink)

This chapter provides a critical reflection on an ethnographic approach led by a non-Indigenous researcher in partnership with an Indigenous community-controlled health organization, and a team of Indigenous and non-Indigenous supervisors, advisors, critical friends, and mentors. The chapter explores the way the three interrelated principles of Indigenist research informed the study, as a critical reflection of the methodology’s achievement of a decolonizing research agenda. The flow of Maiwah provides a metaphor for the chapter’s diverse authorship. Maiwah’s tributaries, inlets, and banks (...) represent author voices at different points while the one River flowing represents coming together to form a broader collective story of the research that still respects the authors’ individual positioning. Maiwah’s flow also signifies the dialogical approach of the research – “tricky ground” for non-Indigenous researchers seeking to privilege Indigenous voices while remaining accountable to their own White privilege, particularly given that at its most basic level, research requires the “extraction of ideas” from participants. Yet, the flow of Maiwah also shows us the possibilities of research, where in this case, researcher and participants together cocreated new knowledge in support of their agendas. This process enabled both research outcomes and increased research capacity and confidence in the host agency and researcher. On this account, decolonizing research is perhaps more about relationship and devolving control over the process than it is about particular methods, and the respectful negotiation of epistemological meanings and representation of particular knowledges that can result. Paper, $27.95.This collection of essays testifies to the growing interest in neo-Kantianism in the Anglophone world. The editors boast that “it is the first of its kind published in English,” though they have been beat to the post by an (...) issue of the The Philosophical Forum (Vol. XXXIX, no. 2, Summer 2008), Back to Kant: Neo-Kantianism and its Relevance Today, edited by Andrew Chignell, Terence Irwin, and Thomas Teufel. Still, claims to priority are of small moment where quality is concerned, and the many valuable essays in this volume more than compensate for second place. In their introductory essay, Makkreel and Luft make a convincing case for the continuing relevance of neo-Kantianism in contemporary philosophy. Basically, nearly every philosophical movement of the twentieth century—phenomenology, existentialism, hermeneutics, positivism, Frankfurt school—was influenced by, or grew out of a reaction to, neo-Kantianism, so that we cannot understand and assess these movements unless we have a handle on neo-Kantianism itself. The editors missed a trick, however, when they failed to mention the concept of normativity, which plays such a big role in contemporary philosophy, and whose roots lie in neo-Kantianism.Despite the high quality of many of its essays, this volume suffers from a lack of balance and perspective. Contemporary scholars on neo-Kantianism tend to focus on the Marburg school, especially the work of Cohen, Cassirer, and Natorp. This volume reflects this bias: almost all the articles are centered on these figures. Only two essays focus on the Southwestern or Baden school: one on Emil Lask by Steven Crowell, another on Dilthey and the neo-Kantians by Makkreel. The latter article, however, is more a defense of Dilthey than a study of the neo-Kantians. The important contributions of the Southwestern school to value-theory, and the logic of history and the social sciences, receive scant treatment.The lack of balance is especially evident in the case of the neo-Friesian school, which is never mentioned. This school of neo-Kantianism prospered in Göttingen in the early twentieth century under the leadership of Leonard Nelson. Its members—the theologian Rudolf Otto (1869–1937), the psychiatrist Arthur Kronfeld (1886–1941), the Nobel Prize winner Otto Meyerhoff (1884–1951), and the mathematician Gerhard Hessenberg (1874–1925)—were eminent in their own right and advocated noble social and political causes. Their circle is of great cultural interest, and it deserves a place in history no less than the Marburg and Southwestern schools. Following Fries, Nelson developed an anthropological interpretation of Kant competing with the logicist interpretation of the Marburg and Southwestern schools. Nowadays Heidegger is given credit for the anthropological interpretation, though its origins ultimately go back to Fries.The bias in perspective becomes explicit in the essay by Manfred Kühn, “Interpreting Kant Correctly: On the Kant of the Neo-Kantians.” Kühn attempts to find the common [End Page 145] interpretation of Kant in the Marburg and Southwestern schools, and locates it in the Platonized version of Kant of the later Cohen, an interpretation that eliminates sensibility and stresses the autonomy of pure thought. Kühn’s generalization is problematic for three reasons: (1) It ignores the anthropological interpretation of the Friesian school; (2) it scarcely works for the Southwestern school, which never eliminated Kant’s sensibility (Kühn bases his interpretation on a single later essay by Rickert, as if it held for all his earlier work and for Windelband and Lask); and (3) it applies only to the later Cohen, who took the plunge toward an objective idealist interpretation only in his 1896 Einleitung mit kritischen Nachtrag zur neunten Auflage der Geschichte des Materialismus. Although there are indeed Platonic tendencies to Cohen’s thinking even in the late 1860s, they do not erase the Kantian dualism between understanding and sensibility, which remains well in place even in the second edition of Kant’s Theorie der Erfahrung (1885). In this paper I argue against the usual interpretation of\nMeinong's argument for nonexistent objects, an\ninterpretation according to which Meinong imported\nnonexistent objects like "the golden mountain" to account\ndirectly for the truth of statements like the golden\nmountain is golden'. I claim instead (using evidence from\nMeinong's "On Assumptions") that his argument really\ninvolves an ineliminable appeal to the notion of pretense.\nThis appeal nearly convinced Meinong at one stage that he\ncould do without nonexistent objects. The reason, I argue,\nwhy he nonetheless embraced an ontology of nonexistents (...) has\nto do with the phenomenology of representation, and not\nwith semantics. (shrink)

An article by Luigino Bruni and Robert Sugden published in this journal argues that market relations contain elements of what they call ‘fraternity’. This Response demonstrates that my own views on interpersonal relations and markets – which originated in the feminist analysis of caring labour – are far closer to Bruni and Sugden's than they acknowledge in their article, and goes on to discuss additional important dimensions of sociality that they neglect.

This study compared professional and amateur classical musicians matched for age, gender, and education on reaction times during the Stroop color-word test, brainwaves during an auditory ERP task and during paired reaction-time tasks, responses on the Gibbs Sociomoral Reflection questionnaire, and self-reported frequencies of peak experiences. Professional musicians were characterized by: lower color-word interference effects , faster categorization of rare expected stimuli , and a trend for faster processing of rare unexpected stimuli , higher scores on the Sociomoral Reflection questionnaire, (...) and more frequent peak experiences during rest, tasks, and sleep. Both groups had high values on the Brain Integration Scale. These findings are interpreted in light of a Unified Theory of Performance, which posits that effectiveness in any area is influenced by one’s level of mind-brain development—emotional, cognitive, moral, ego and cortical development—with higher mind-brain development supporting greater effectiveness in any domain. Adorno and Levinas argue from distinct yet intersecting perspectives that there are pathological forms of freedom, formed by systems of power and economic exchange, which legitimate the neglect, exploitation and domination of others. In this paper, I examine how the works of Adorno and Levinas assist in diagnosing the aporias of liberty in contemporary capitalist societies by providing critical models and strategies for confronting present discourses and systems of freedom that perpetuate unfreedom such as those ideologically expressed in possessive individualist (...) and libertarian conceptions of freedom. This paper considers the debate over how we attribute beliefs, desires, and other mental states to our fellows. Do we employ a theory of mind? Or do we use simulational brain mechanisms, but employ no theory? One point of dispute between these theories focuses upon our ability to have empathic knowledge of the mind of another. I consider whether an argument posed by Ravenscroft settles the debate in favor of Simulation Theory. I suggest that the consideration of empathy does not (...) settle the dispute. Then I look at recent results from false memory research and other research employing neural imaging. I suggest that new discoveries there may help shape the future of the empirical dimension of the debate. (shrink)

I'll begin this paper with an autobiographical example — an instance of a common enough kind of case involving agents who are faced with making a choice they strongly care about, but who have tendencies that incline them towards choosing an option they prefer not to choose. This paper involves one crucial assumption; namely, that the statistical predictions of quantum mechanics for Bell's variant of the EPR experiment will continue to be verified as detector efficiencies are improved and the need for coincidence counters is eliminated. This assumption entails that any hidden-variables theory for quantum mechanics must violate Bell's inequality--the inequality derived in Bell (1964). It is shown here that four locality conditions are involved in the derivation of Bell's inequality; and that a violation of any of (...) the four locality conditions will either entail the existence of superluminal influences or the existence of superluminal signals (superluminal influences that can be used to transmit information), if conspiratorial theories can be ruled out. The attempts so far to rule out conspiratorial theories are all found to be rather dubious, but there are other considerations developed here that rule them out convincingly. Finally, it is demonstrated that violations of each of the four locality conditions can be used to transmit information superluminally, if certain auxiliary conditions are satisfied. This is of particular interest because one of these conditions corresponds to a condition dubbed "completeness" by Jon Jarrett. Jarrett and others have suggested that violations of completeness cannot be used to send information superluminally. Demonstrating otherwise is, perhaps, the most significant result obtained in this paper. (shrink)

We will consider alternative ways that Kant’s philosophical views on ethics generally and on punishment more particularly could be brought into harmony with the present near consensus of opposition to the death penalty. We will make use of the notion of the contemporary consensus about certain issues, particularly equality of the sexes and the death penalty, found in widespread agreement, though not unanimity. Of course, it is always possible that some consensuses are wrong, or misguided, or mistaken. We should not (...) put too much philosophical weight on the notion of a consensus here. If there is a consensus for the equality of women as citizens, and against the death penalty, this will simply suggest to us that we will want to reconsider Kant’s views on such topics. In both instances mentioned, his views lie outside the current consensus. We will consider how to revise Kant’s views to bring them into accord with these current consensuses, within a theory that is still, in as significant a sense as possible, Kantian. Since the use of the idea of a consensus is a sort of short-cut, there will not be much direct discussion of arguments for or against the equality of women as citizens, or for or against the advisability of using the death penalty. Yet the discussions of these issues will illuminate certain facts about the structure of Kant’s moral and political theories, and about how the basic principles within those theories relate to particular moral applications or topics. If we can still end up with a thoroughly Kantian view on the death penalty, that also will tell us something about the relation of Kantian ethical and legal principles to the death penalty as that issue is discussed today. Opposition to the death penalty in present day circumstances is not at variance with the basic principles of Kantian ethical, political, and legal theory, including his retributivism in the justification of punishment. Indeed, there is a way of revising Kant’s views to bring them into harmony with abolition. (shrink)

There is a dilemma facing mainstream environmental ethicists. One of our leading spokesmen, Holmes Rolston, III, offers a rich ethical position, but one that lacks internal connections between principles relevant to the environment and principles relevant to human society. These principles are just different; thus no higher-order guidance is available to cope with cases of conflict between them. A second major spokesman, Baird Callicott, recommends a "land ethics" that is internally coherent but sadly inadequate for addressing many distinctly human ethical (...) concerns. To escape this dilemma I advocate an alternative worldview, "Personalistic Organicism." On this view, inspired by Alfred North Whitehead, a continuum of values, pervading the universe, can undergird a unified ethics in which human persons are recognized as especially valuable without rupturing the continuities that bind humanity to the rest of the living (and nonliving) environment. During the past decades several philosophers of science and social scientists have been interested in the problems of causation. Recently attention has been given to probabilistic causation in dichotomous causal systems. The paper uses the basic features of probabilistic causation to argue that the causal modeling approaches developed by such researchers as Blalock (1964) and Duncan (1975) can provide, when an additional assumption is added, adequate qualitative measures of one variableś causal influence upon another. Finally, some of the difficulties and (...) issues involved in developing adequate quantitative measures are discussed, and it is concluded that the causal modeling measures cannot provide adequate quantitative measures. I advocate a method that strives to interpret important historical figures in philosophy as presenting philosophical systems of thought. This kind of systematic interpretation, as I shall call it, begins with the supposition that the philosophy being interpreted is itself systematic. This sometimes requires recovering the obscured systematicity. Section I gives a positive characterization of systematic interpretations. Section II notes some of the special obstacles that these interpretations must overcome if they are to be successful. Section III gives a brief (...) sketch of how one might systematically approach Locke’s Essay Concerning Human Understanding. That text is a good test case because Locke professes systematicity, but historians have produced daunting arguments for the conclusion that the text fails to present a coherent system. (shrink)

What follows is an attempt to do some conceptual housekeeping around the notion of secret law as provided by Christopher Kutz (2013). First I consider low-salience (or merely obscure) law, suggesting that it fails to capture the legal and moral facts that are at stake in the case which Kutz used to motivate it. Then I outline a theoretical contrast between mere obscurity and secrecy, in contrast to the 'neutral' account of secrecy provided by Sissela Bok (1989). The upshot of (...) the two sections is that low-salience law is neither secret law nor necessarily problematic, though it closely resembles a kind of law that is both secret and problematic: namely, those legal obscurities that subvert manifest interests related to the informational needs of citizens. The ensuing argument undermines the fiction of constructive presence found in Austin and Blackstone. (shrink)
